China Launches Its First Judgment Rules Database for Technology-Related IP Cases

        Release time:2020-04-20 09:52:59 source:ipc.kfyzwh.com

The Intellectual Property Court of the Supreme People's Court launched China's first judgment rules database, called "Zhi Ji", on collection, summary and publicity of technology-related IP cases on April 16.

The database currently includes judgments and rules with the most typical and guiding values from cases the IP Court concluded in 2019.

The database innovatively designs the "mind map of rules" that visually presents the full picture of the judgment rules, facilitating judges' active learning and quick mastering judgment rules of technology-related IP cases. It will improve judicial efficiency of handling similar cases and promote collaborative "1+76" mechanisms between the IP Court and high courts, intellectual property courts and special tribunals at all levels nationwide.

An annual report and judgments summary of the IP Court were also released on the same day.

The report highlights trial work, mechanism reform and the international exchanges the court carried out in the past year as well as its joint efforts in judicial openness, investigation and research and operation with other departments.

Forty rules extracted from 36 typical cases are included in the judgments summary illustrating the court's judicial ideology, trial ideas and judgment approaches when handling new, difficult and complicated technological IP-related cases.

The judgments summary and the database will promote unification of criterions of technology-related IP cases and contribute to improvement of quality and efficiency of such cases.

It's worth mentioning that during the outbreak of the COVID-pandemic, the IP Court took full advantage of information platform and developed online trials and office procedures.

The IP Court also established the guidance on online litigation and further applied online litigation platforms including the "mobile micro court" to ensure high-quality trial during the pandemic period.
